[ARCHIVED] Council tightens development standards, adopts marijuana regs

Last night, the City Council approved items on the consent calendar with a 5-0 vote, which include:

  • Anagreement for manhole inspection and data collection to complete a sewer condition analysis. This is done to identify issues in the sanitary sewer system that require immediate repair or maintenance.
  • A grant of easement to Southern California Edison for underground and overhead power lines at the Alanmay parking lot

The City Council also heard two items, which include:

Prohibition of commercial marijuana activities and imposing regulation for the personal cultivation of marijuana

The proposed zone text amendment would amend the city’s municipal code to prohibit all nonmedical cannabis activity, including cultivation, processing, manufacturing, storing, distribution, testing, transportation and the sale of nonmedical cannabis. This act is authorized to the city by the Adult Use of Marijuana Act.

In addition, the zone text amendment would also appeal and readopt new provisions prohibiting all commercial uses related to medical marijuana, including restrictions on personal growth.

The City Council voted 5-0 (with amendments) to move the ordinance for a second reading at the next meeting

Zone text amendment for the development standards and review process for the city’s single family residence zone 

Two years ago, the City Council adopted a moratorium on the demolition of single family homes and the development of a new second story in the single family residence zone (R-1). Last year, the City Council extended the moratorium for another year, allowing for the development of a new second story with approval from the Design Review Commission. This moratorium is set to expire on October 5, 2017, so staff recommends that the City Council introduce two ordinances:

  • Ordinance No. 638-C.S.
    • This ordinance relates to the development standards and review processes for the single family residence zone.
  • Ordinance No. 639-C.S.
    • In order for the ordinance to take into effect immediately, staff also recommends the passage of this urgency ordinance.

The City Council voted 5-0 (with amendments) to move the ordinance for a second reading at the next meeting

New business items included:

A debt management policy

This debt management policy is developed to provide guidance in the issuance and management of debt by the city. This policy establishes the conditions for the use of debt, and ensures that the debt capacity and affordability are adequately considered. The policy also ensures that the city minimizes its interest and issuance costs and ensures that the city maintains the highest possible credit rating.

Approved by a vote of 4-1, with Vice Mayor Harrington voting against the motion

A request to approve the fiscal year 2017-18 Senate Bill 1 project list and to amend the fiscal year 2017-18 budget to include the Senate Bill 1 project list

Senate Bill 1, also known as the Road Repair and Accountability Act of 2017, gathers a portion of funds generated by increased fuel taxes and vehicle registration fees that are distributed annually to eligible cities and counties for basic road maintenance, rehabilitation and other critical safety road projects. The city is currently estimated to receive $228,399, which will be used to resurface 1.5 miles of pavement.

Staff recommends that the City Council approve the project list to include the additional funds provided by SB 1.

Approved by a 4-0 vote, with Vice Mayor Harrington recusing himself from appearance of potential conflict
